AI Features and Agents Terms
Last updated October 18, 2026
Effective date: 18 October 2026
These AI Features and Agents Terms (the “AI Terms”) apply when you use the artificial-intelligence features of the services of MoreBasket Private Limited (“morebasket”, “we”, “us”). They are part of our Terms of Service. Terms defined there have the same meaning here. If there is a conflict between these AI Terms and the Terms about AI Features, these AI Terms apply.
1. What the AI Features are
“AI Features” means the features of our services that use machine-learning or generative models, including:
- the AI store builder, which drafts a store’s design, page copy and starting catalog from a description you write;
- Shopmate, an AI assistant that makes changes to a draft of your design when you ask in plain words, and that works inside your admin to help you run your shop;
- the AI workforce, AI agents (currently Product, SEO, Builder, Order and Inventory) that take on routine store tasks such as drafting listings, writing search copy, editing pages, handling order tasks and checking stock, using your live store data;
- checkout for AI shopping agents (see section 8); and
- any other feature we describe as using AI.
“Output” means the text, images, code, designs, data and actions an AI Feature produces for you or on your behalf. “Input” means everything you give an AI Feature, including prompts, descriptions, instructions, files and the store data you let it use.
2. AI can be wrong, and you stay in charge
2.1. How it works. The AI Features generate Output by predicting likely results. They can produce Output that is inaccurate, incomplete, out of date, biased, offensive, misleading, inconsistent from one request to the next, or similar to Output produced for someone else. They can also misunderstand an instruction. They do not know your legal situation, your tax position, your suppliers, your stock or your customers except through the data you provide, and they cannot guarantee any result such as sales or search ranking.
2.2. You are responsible for Output. You must review Output before you publish it, send it to a Customer, rely on it or let it take effect. As between you and us, you are responsible for everything published or done in your Store, whether you wrote it, an AI Feature generated it, or an AI agent did it with the permissions you gave. In particular, you are responsible for the accuracy and legality of product descriptions, prices, claims, translations, search copy, policies, order decisions and stock figures.
2.3. No professional advice. Output is not legal, tax, financial, medical, safety or other professional advice. Do not rely on it for any of these.
2.4. Disclosure. Some laws require you to tell people when content is AI-generated or when they are dealing with an AI system (for example, the transparency rules of the EU AI Act, and certain state laws). You are responsible for meeting those obligations in your Store and your marketing.
3. Controls: approval, drafts and undo
3.1. Drafts and publishing. Shopmate changes a draft of your design and does not publish for you. You decide when a change goes live. Small edits made through Shopmate apply to the draft immediately and can be undone within the same session. Removing something or making a larger change asks you to confirm before it is applied.
3.2. Approval for agents. You decide what each AI agent may do on its own and what must wait for your approval. An agent that is set to need approval will not carry out the task until you approve it. We recommend that you require approval for anything your Customers will read or that involves money, orders, refunds or customer communication, and relax it only when you trust the job. The controls available to you may change as the product develops.
3.3. Your settings are your decision. If you let an agent act automatically, you are authorising it to take those actions in your Store, and you are responsible for the results, as if you had taken them yourself.
3.4. Logs. We keep a record of the tasks that AI agents carry out in your Store so you can see what was done. It is available to you in the admin, and we may use it to provide support and investigate problems.
4. Your Input
4.1. Rights. You confirm that you have all rights needed to give us your Input and to let us use it to provide the AI Features, and that it does not break the law or the Acceptable Use Policy.
4.2. Personal and sensitive data. Only give the AI Features the personal data they need for the task you ask for. Do not put sensitive personal data (such as health, biometric, financial-account, government-identifier or children’s data), or confidential information you are not allowed to share, into prompts. Where an AI Feature processes personal data from your Store (for example, to draft a reply about an order), we do so as your processor under the Data Processing Addendum.
4.3. Model providers. To generate Output, your Input and the relevant store data are sent to third-party model providers that act as our subprocessors, listed in Subprocessors. We choose providers for the features, and we may change them. We may also change the models we use, which may change the results.
5. How we use your data in the AI Features
5.1. To provide the service. We use Input and Output to provide the AI Features to you, to keep them secure, to prevent abuse, to provide support and to fix errors.
5.2. No training of foundation models. We do not use your Input, Output, store content, products or Customer Data to train or fine-tune generalist foundation models, and we require our model providers by contract not to use them to train their models.
5.3. Improving our own service. We may use the metadata about how the AI Features are used (such as which features are used, how long tasks take, error rates and whether Output was accepted or edited) to improve the AI Features. We may use data derived from that metadata in an aggregated or de-identified form. Where we need to look at the content of Input or Output to fix a problem you reported, investigate abuse or investigate a safety issue, access is limited to the staff who need it and is logged.
5.4. Retention. We keep Input and Output only as long as needed for the purposes above and as the Privacy Policy and the Data Processing Addendum describe. Our model providers may keep Input and Output for short periods for abuse monitoring, as set out in their agreements with us.
6. Ownership and use of Output
6.1. Ownership. As between you and us, and subject to the Terms, we assign to you whatever rights we have in Output generated for you. You may use Output in your Store, marketing and business.
6.2. No promise of originality. Output may be similar to Output generated for other people, may include elements that resemble third-party works, and may not be protected by copyright or other rights in some places. We do not promise that Output is original, non-infringing or capable of protection. You are responsible for checking Output, especially images, logos, brand names, music, quoted text and claims, before you use it commercially.
6.3. Our rights. We keep all rights in the AI Features, our models, prompts and software, and in the designs, templates and components the AI Features draw on. Output does not give you rights in them beyond using the Output.
6.4. Restrictions. You must not use Output or the AI Features to develop or train a competing AI product or model, to extract or copy our models, prompts, safeguards or underlying systems, or to bypass usage limits.
7. AI credits, limits and availability
7.1. AI Features are metered in “AI credits” included in your plan each month, as the Billing, Refunds and Cancellation Policy describes. When your credits run out, AI Features pause until they reset or you change plan, and the rest of the Services continue.
7.2. Which agents are available depends on your plan.
7.3. AI Features depend on third-party models and infrastructure, and may be slower, less accurate, or unavailable at times. We may change, limit, suspend or discontinue an AI Feature, a model or a provider at any time, and we may refuse a request that we reasonably think breaks the law or the Acceptable Use Policy. We may filter or block Input and Output to enforce it.
8. Checkout for AI shopping agents
8.1. What it is. Where you enable it, AI shopping assistants and other AI agents that follow the Agentic Commerce Protocol can discover your products and buy from your Store on behalf of their users. At this time, this works through Stripe and requires Stripe’s own program enrolment, and it is not self-serve: you must contact us to set it up.
8.2. You remain the seller. Orders placed this way are orders from your Store, and appear in your normal list of orders. You are the seller and are responsible for them in the same way as for any other order, including price accuracy, availability, tax, fulfilment, returns and Customer service.
8.3. Third-party assistants. Third-party AI assistants and the companies that run them are Third-Party Services. We do not control which products they recommend, how they rank or describe them, or what they tell the people who use them. We do not promise that any assistant will show or buy your products, and we are not responsible for what they do.
8.4. Payments and fraud. Payments for these orders go through the payment provider and are subject to its terms and rules. You are responsible for chargebacks and disputes on these orders in the same way as for others.
9. Prohibited uses
You must not use the AI Features in the ways listed in section 6 of the Acceptable Use Policy. You also must not use them for any practice that the EU AI Act or other law prohibits, or for high-risk uses such as decisions about a person’s credit, employment, education, housing or access to essential services. The AI Features are not designed or authorised for those uses.
10. Reporting problems
If an AI Feature produces Output that is harmful, unsafe, unlawful or infringing, or an agent does something you did not intend, tell us at admin@morebasket.com with as much detail as you can. We will look into it, and where there is a defect we will work to fix it. This does not limit your own responsibility under section 2.
11. Disclaimers and liability
11.1. To the fullest extent the law allows, we provide the AI Features and all Output “as is” and “as available”, without any warranty that Output will be accurate, complete, lawful, non-infringing, original or fit for your purpose, or that AI Features will be uninterrupted, error-free or free of harmful results. Section 21 (Warranties and disclaimers) and section 22 (Limitation of liability) of the Terms apply to the AI Features and Output.
11.2. We are not liable for loss that results from your use of, or reliance on, Output you did not review, for actions an agent takes within the permissions you gave it, or for what Third-Party Services, including model providers and shopping assistants, do or fail to do. Nothing in these AI Terms limits any liability that cannot be limited by law.
12. Changes
We may update these AI Terms as the features and the law change, which they do quickly in this field. We will give notice of material changes as the Terms describe, and we will update the effective date above.
