MoreBasket Private Limited (“morebasket”, “we”, “us”) respects intellectual-property rights and expects the people who use our services to do the same. This policy explains how rights holders can report content on a Store built with morebasket that they believe infringes their rights, how Store owners can respond, and what we do about repeat infringers. It is part of our Terms of Service and our Acceptable Use Policy.

Stores are run by our customers, who are responsible for what they publish. We act as a hosting and technology provider, and we respond to valid notices.

If you believe that content in a Store built with morebasket infringes your copyright, send a written notice to our designated copyright agent:

Designated agent: Sathish, Copyright Agent, admin@morebasket.com, Ozone Techno Park, 24, Rajiv Gandhi Salai, Navalur, Chennai, Tamil Nadu 600130, India

Your notice must include, as the United States Digital Millennium Copyright Act (17 U.S.C. § 512(c)(3)) requires:

  1. your physical or electronic signature, or that of a person authorised to act for the owner of the right;
  2. identification of the copyrighted work you say has been infringed (or, for several works on one site, a representative list);
  3. identification of the material you say infringes, with enough information for us to find it, such as the web address of the page;
  4. your contact details, including your name, postal address, telephone number and email address;
  5. a statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent or the law; and
  6. a statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorised to act for the owner.

Notices that lack these details may not be acted on. Please be careful: under the DMCA, anyone who knowingly misrepresents that material is infringing can be liable for damages, including costs and legal fees. If you are not sure that material infringes your copyright, you may want to talk to a lawyer first.

2. Reporting trade-mark, counterfeit and other rights complaints

If your complaint is about a trade mark, counterfeit goods, a design, a patent, publicity or privacy rights, or other rights, send a notice to admin@morebasket.com that includes: your name and contact details; the right you hold (for example your trade-mark registration number and the country it covers); the web address of the content; why you say it infringes your right; a statement that you have a good-faith belief that it does; and a statement that the information is accurate and that you are the rights holder or authorised to act for them. For counterfeit reports, tell us how you can show the goods are not genuine.

3. Notices under EU and UK law

If you are in the European Union or the United Kingdom and believe that content is illegal, you may notify us at admin@morebasket.com. Please include a clear explanation of why you think the content is illegal, the exact location (the web address), your name and email address (unless the content is about a child-abuse offence), and a statement confirming that you believe in good faith that the information is accurate and complete. We will confirm receipt and tell you our decision and, where relevant, how to challenge it.

4. What we do

4.1. Review. We will review a notice that includes the information above. We may ask for more information.

4.2. Action. If a notice is valid, we will act promptly, normally by removing or disabling access to the material, or by suspending the Store, and we may restrict the relevant Account while the matter is resolved.

4.3. Telling the Store owner. We will tell the Store owner, forward a copy of the notice (including your name and contact details, which the law usually requires), and explain how to respond.

4.4. No decision on the merits. We do not decide who owns a right. We act on notices and counter-notices as the law provides. Disputes between rights holders and Store owners are for them, and the courts, to resolve.

5. Counter-notice by a Store owner

5.1. If you are a Store owner and you believe that material was removed or disabled by mistake or because it was misidentified, you may send us a counter-notice at admin@morebasket.com. It must include:

  1. your physical or electronic signature;
  2. identification of the material that was removed or disabled and where it appeared before;
  3. a statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled by mistake or misidentification;
  4. your name, address and telephone number, and a statement that you consent to the jurisdiction of the federal court for the district in which your address is located (or, if your address is outside the United States, any judicial district in which we can be found), and that you will accept service of process from the person who sent the original notice or their agent.

5.2. When we receive a valid counter-notice, we will forward it to the person who sent the original notice. Unless that person tells us within 10 business days that they have started a court action against you, we may restore the material in not less than 10 and not more than 14 business days after we receive the counter-notice.

6. Repeat infringers

We have a policy to terminate, in appropriate circumstances, the Accounts of users who repeatedly infringe the intellectual-property rights of others. We decide this case by case, taking account of the number and seriousness of the notices, whether they were resolved in the Store owner’s favour, and all other relevant facts.

7. Our right to act on our own

Apart from notices, we may remove content or suspend a Store if we reasonably believe that it infringes rights or breaks the law, as the Terms and the Acceptable Use Policy allow.
