These Beta Program Terms (the “Beta Terms”) apply while MoreBasket Private Limited (“morebasket”, “we”, “us”) offers any part of its services as a beta, preview, early-access or pre-release version (each a “Beta Feature”), and to the waiting list for access. They add to our Terms of Service (the “Terms”). Terms defined there have the same meaning here. If these Beta Terms conflict with the Terms about a Beta Feature, these Beta Terms apply.

1. The waiting list

1.1. No promise of access. Joining the waiting list reserves nothing and does not guarantee that you will be invited, or when. We decide, in our discretion, whom to invite and in what order. We may close or reset the list at any time.

1.2. What it costs. Joining the waiting list is free. No payment is taken to join it.

1.3. Your data. When you join, we collect your email address and the technical and campaign details described in our Privacy Policy, and we use them to tell you about access and, if you agree, about the product. You can ask us to remove you at any time at admin@morebasket.com, and every message we send will tell you how to opt out.

1.4. Invitations. An invitation is personal to you and may not be transferred or sold.

2. Beta Features are pre-release

2.1. Status. Beta Features are still being developed and tested. They may contain errors, be incomplete, perform unpredictably, change without notice, or be discontinued. We make no promise that a Beta Feature will be made generally available, or that it will stay the same if it is.

2.2. No service levels. Beta Features, and the Services while they are in beta, have no availability or response-time commitments. We aim to keep them running well, but they may be interrupted.

2.3. Your choice to use them. You use Beta Features voluntarily and at your own risk. Do not use a Beta Feature for anything where a failure could cause significant harm or loss, and take care before you rely on it for a critical part of your business.

2.4. Real customers and real orders. If you use the Services to sell to real customers, you remain the seller and are fully responsible for your Store, your orders and your Customers, as the Terms state. We do not take responsibility for the sales, refunds, delivery, disputes or taxes in your Store because the Services are in beta.

3. Your data in beta

3.1. Back it up. Beta Features may cause data to be lost, corrupted or changed. You should keep your own copy of anything important, and you can export your products, orders and customers using the export tools in the Services.

3.2. Changes and endings. If we plan to end a Beta Feature, or reset data as part of a major change, we will, where we reasonably can, give you at least 30 days’ notice by email or in the Services, and make a way for you to export your data before it ends.

3.3. Data protection. The Data Processing Addendum and the Privacy Policy apply to Beta Features in the same way as to the rest of the Services.

4. Early-access pricing and plans

4.1. Prices and plans can change. During the beta, plans, limits, prices and billing terms may change. Prices shown to you during the beta are not a commitment to the same prices after it.

4.2. Early-access offers. If we offer you a special price, an extended free period or other early-access benefit, its terms are those we state when we make the offer. Unless it says otherwise, it applies for the period stated and then the standard terms apply, and we will tell you before it ends.

4.3. Moving out of beta. When a Beta Feature or the Services leave beta, we may ask you to accept new or updated terms and to choose a plan. We will tell you in advance how your Store, data and plan will continue.

5. Feedback and testing

5.1. We may ask for your feedback, and you may give it. Feedback is covered by section 10 of the Terms. We may use it, without charge, to improve the Services.

5.2. We may monitor, collect and analyse information about how Beta Features are used (for example errors, performance and feature usage) to find and fix problems, as the Privacy Policy describes.

5.3. You are not paid for taking part in the beta, and nothing in it makes you our employee, contractor or partner.

6. Confidentiality of unreleased features

6.1. Beta Features, their performance, features and the existence of any non-public feature that we show you in the beta, are our Confidential Information under section 16 of the Terms. You must not publicly disclose, publish or share screenshots, reviews, benchmarks or descriptions of non-public Beta Features without our written permission.

6.2. This does not stop you from telling people that you use morebasket, from describing features that we have made public, or from sharing your own Store and its content.

7. Disclaimers and liability

7.1. To the fullest extent the law allows, Beta Features are provided “as is” and “as available” with all faults, with no warranty of any kind, including any warranty that they will work, will not lose data, or will become generally available.

7.2. Our liability to you in connection with a Beta Feature is subject to sections 21 and 22 of the Terms. Because beta access may be free, the cap in section 22.2 of the Terms may be the minimum amount stated there. Nothing here limits liability that cannot be limited by law.

8. Ending your participation

You may stop using a Beta Feature at any time, and you may close your Account as the Terms describe. We may end your participation in the beta, or remove your access to a Beta Feature, at any time, with notice where we can. Sections 6, 7 and 8 and the sections of the Terms that are meant to survive continue after your participation ends.
